Planning Board Meeting Minutes
February 18, 2014

1. Call to Order: The regular meeting was called to order at 7:02 PM.

2. Attendance: Members present were, Chair- Dan Peaco, Herb Olsen, Alternate - Rick Jackson & Alternate - Stan Brett. (Absent – Secretary -Karen Turino, Vice Chair - David McVety & Beth Damon) *Motion to move both alternates up as voting members.

3. Announcement of Quorum: Board had a quorum

4. Approve Secretary’s Report:
A. Regular Meeting Minutes January 21, 2014 *Motion to accept minutes. SB/HO – Unanimous.

5. Discussion & Comments from public:
A. None.

6. Residence Based Business Applications:
A. Craig Cote dba Barred Owl Daylilies. Map R10 Lot 016, 167 Poplar Ridge Rd. Craig and his business partner Rex have been selling plants as a hobby since they both retired. This is a mail order business that operates through email. They will not be having people come to the residence. If someone wanted to call for pickup that would be considered. All sales will be primarily mailed through postal service. This business will operate about 2 months out of the year. May 1st through end of June. No signs will be needed and no off-street parking necessary. CEO has no concerns. All PB members agree Site Plan Review not necessary. – Unanimous. DP: The Town no longer charges any fees for RBB as of 2/5/14 BOS mtg.  

7. Shoreland Zoning Applications:
A. Olive Burkitt being represented by Ken Bartow. Map U-1, Lot 8 Saturday Pond Road on Saturday Pond. Mrs. Burkitt’s cottage is currently 12-15’ from Saturday Pond. Non-conforming lot and non-comforming structure. Applicant would like to tear down existing cottage and (2) sheds and rebuild cottage. They understand it would need to be moved back to the most practical location behind the 25’ setback line. DP: We are going to need a site walk on this. RJ: We don’t have enough information at this time to make any decisions. HO & SB: Because of the size it does limit how much applicant is able to do. It looks like they can move closer to the garage and go back to the furthest practical extent. Email from Susan Haber who lives to the West of the property, is requesting trees and shrubs not be disturbed. (Submitted into public record). *Site Walk scheduled for March 18th @ 5:30 PM weather permitting, and if March doesn’t work because of snow on the ground, it will be rescheduled for April 15th @ 5:30 PM. Abutters do not need to be notified, but TT will post on website.  

8. Site Plan Applications:
A. None.

9. Subdivision Application:
A. Jim Robbins for Pleasant Lake Overlook, Map R9, Lot 38. Asking for an extension of subdivision and removal of sprinkler requirement. In 2009 PB gave a permit to L&R logging to put in a subdivision, PLO on Powhatten Road. Time has expired and they are requesting an extension of subdivision and removal of sprinkler requirement. *Client phoned and due to weather is requesting to be on the March 18th Agenda.

10. Upcoming Dates:
A. Planning Board Meeting March 18, 2014 at 7:00 PM.
B. Planning Board Site Walk March 18, 2014 at 5:30 PM. *Weather permitting. (If snow is on the ground, it will be rescheduled for April 15, 2014 at 5:30 PM)

11. Discussion & comments from Code Enforcement Officer:
A. MMA letter to CEO.  Sketch Plan of proposed lot split between existing cottages on Pleasant Lake. Tax Map U16 Lot 4. CEO: MMA’s response to this was that if the lots were existing and the buildings were existing they do not need to come before PB. According to them, no changes are being made, it is just a split. It all happened before subdivision laws came into play. The ordinance says under non-conforming lots, they can do that. CEO would like to see the lines identified and confirmed between all parties. The applicant’s intention is to settle property line w/ abutter and come back before PB.

12. Discussion & comments from Board:
A. Sunset Clause in Subdivisions Discussion: An 'expiry date' has come to the end on certain Subdivisions in town. CEO & PB agree Pleasant Lake Overlook, Poplar Ridge and Howes Subdivision fit this criteria and will review at next PB meeting. Discussion: The Registry of Deeds should be notified. PB to discuss what action to take. *Tabled until an upcoming meeting when more PB members present.
B. AVCOG Maps have been replaced. TT will hole punch and bring to next meeting.

13. Adjournment:
With no further business, the meeting was adjourned at 8:45 PM. – Unanimous.
